What constitutes data?

Who owns it? 

Since when is it appropriate for school districts to release the names and addresses of choice students to lobby groups?

Since FERPA rights were unceremoniously lessened by President Obama about 4 years ago, now allowing third party interests access to student data. The release has no litmus threshold other than "an interest in education", to gain 3rd party access. So yes, NIKE, Pepsi, Disney tours, Verizon, Walmart, Google, Apple, Gatorade, Canon, Gymboree et al qualify for permitted access---for a fee, of course---to the richest data mine on the planet. Oh, potential employers too!
